Privacy policy

DELIVERY AND GENERAL CONDITIONS 

 

Article 1 General

These terms and conditions of delivery apply to the conclusion, content and fulfillment of all agreements concluded between the buyer and Mobi Movi. The buyer's general (purchasing) conditions do not apply to these agreements, unless expressly agreed otherwise in writing.

 

Article 2 Definitions

In these terms and conditions of delivery, buyer is defined as: the natural or legal person who has instructed Mobi-Movi to deliver products or carry out work.

Article 3 Price

a. Mobi-Movi is exempt from sales tax under Article 25, OB 1968 Act. The prices of all products that can be ordered via this website are exclusive of any sales tax (VAT), unless stated otherwise and excluding shipping costs.

b. The prices of goods listed on this website are subject to change for any reason.

 

Article 4 Delivery

a. The delivery times stated by Mobi-Movi are indicative. Exceeding any delivery period does not entitle the buyer to compensation.

b. Delivery of the products takes place at the place and time at which the products are ready for shipment to the buyer.

c. Mobi-Movi sells worldwide. For orders that need to be shipped abroad, payment in advance is requested either by bank transfer; either by payment via credit card.

 

Upon delivery of the item with the shipment of your choice, the laws and regulations of the shipper become the regulating laws of the shipment. The risk of loss of the items passes to the carrier upon delivery. Mobi-Movi will not be held liable for lost or delayed shipments after delivery to the shipping company.

 

Article 5 Complaints and liability

a. The buyer has the obligation to examine upon delivery whether the products comply with the agreement. If this is not the case, he must notify Mobi-Movi in writing within eight (8) days. After this period has expired, the buyer is deemed to have accepted the goods.

b. If it has been demonstrated that the products do not comply with the agreement, Mobi-Movi is obliged to replace them with new products or to refund the invoice value thereof.

c. If the buyer does not wish to purchase a product for any reason, he has the right to return the product to Mobi-Movi within two (2) weeks after delivery. Returns are only accepted if the product is undamaged. The costs for returns are borne by the buyer.

 

Article 6 Payment

a. Unless otherwise agreed, the buyer must pay the price and other amounts due under the agreement within 15 days after delivery into the account indicated by Mobi-Movi, without being able to rely on any discount, settlement or suspension. If the period of 15 days is exceeded, the buyer is legally in default towards Mobi-Movi.

b. Mobi-Movi has the right to charge interest of 1% per month on its claim after 15 days.

c. If Mobi-Movi demands payment from the buyer after the payment term has expired, the buyer will also owe an amount of 25 euros in administration costs.

d. If Mobi-Movi assigns its claim against the buyer to third parties for collection, all associated costs, both judicial and extrajudicial, will be borne by the buyer. The extrajudicial costs are set at at least 15% of Mobi-Movi's claim.

e. Payments made by the buyer will first serve to settle all interest and costs due. Only after payment of these amounts will any payment be deducted from the principal sum.

f. Packaging and shipping costs will be charged for each order.

 

Article 7 Retention of title

The goods delivered by Mobi-Movi remain its property until all claims of Mobi-Movi have been paid in full. The risk regarding the goods passes at the time of delivery.

 

Article 8 Intellectual and industrial property rights

Intellectual property rights that rest on the products supplied by Mobi-Movi are fully and unconditionally respected by the buyer.

 

Article 9 Communication

For incorrect or delayed transmission of order data and communications as a result of the use of the Internet or any other means of communication in the traffic between the buyer and Mobi-Movi, or between Mobi-Movi and third parties, insofar as it relates to the relationship between the buyer and Mobi-Movi, Mobi-Movi is not liable.

 

Article 10 Force majeure

Without prejudice to its other rights, in the event of force majeure, Mobi-Movi has the right, at its own discretion, to suspend the execution of an order or to terminate the agreement without judicial intervention, by notifying the buyer in writing. and without Mobi Movi being obliged to pay any compensation.

 

Article 11 Exclusion of precedent effect

If Mobi-Movi allows deviations from these general terms and conditions for a short or longer period of time, whether tacitly or not, this does not affect its right to demand immediate and strict compliance with these terms and conditions. The buyer can never assert any rights based on the fact that Mobi-Movi applies these conditions flexibly.

Article 12 Dutch law

Agreements concluded between Mobi-Movi and the buyer are exclusively governed by Dutch law. All disputes between parties will be submitted exclusively to the competent court in the Netherlands.

 

Article 13 Image and text material

Images and/or texts may not be reproduced, sent or printed without permission from Mobi-Movi.

 

Article 14 Terms of Use

The mobiles are intended as a decorative object and not suitable as toys for children.

About our privacy policy

Mobi-Movi cares a lot about your privacy. We therefore only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

 

This privacy policy applies to the use of the website and the services provided by Mobi-Movi. The starting date for the validity of these conditions is 30/04/2020, with the publication of a new version the validity of all previous versions expires. This privacy policy describes what information about you is collected by us, what this information is used for and with whom and under what conditions this information may be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have with regard to the personal data you provide to us.

About data processing

Below you can read how we process your data, where we store it, which security techniques we use and for whom the data is visible.

 

Online store software WIX

Our online store was developed with WIX software. Personal data that you make available to us for the benefit of our services will be shared with this party. WIX has access to your data to provide us with (technical) support, they will never use your data for any other purpose. WIX is obliged to take appropriate security measures based on the agreement we have concluded with them. These security measures consist of the application of SSL encryption and a strong password policy. WIX uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored. WIX reserves the right to share collected data within its own group to further improve its services.

 

Hostnet

We use the services of hostnet for our regular business e-mail traffic. This party has taken appropriate technical and organizational measures to prevent misuse, loss and corruption of your and our data as much as possible. Hostnet does not have access to our mailbox and we treat all our e-mail traffic confidentially.

WIX Payment provider

We use the WIX payment provider platform to process (part of) the payments in our online store. WIX payment provider processes your name, address and residence details and your payment details such as your bank account or credit card number. WIX payment provider has taken appropriate technical and organizational measures to protect your personal data. WIX payment provider reserves the right to use your data to further improve its services and to share (anonymized) data with third parties in this context. In the case of an application for a deferred payment (credit facility), WIX payment provider shares personal data and information regarding your financial position with credit rating agencies. All the above-mentioned guarantees with regard to the protection of your personal data also apply to the parts of WIX payment provider's services for which they engage third parties. WIX payment provider does not store your data for longer than permitted by legal terms.

 

Reviews Shipping and logistics

Post companies

If you place an order with us, it is our job to have your package delivered to you. We use various postal services to carry out deliveries. It is necessary for us to share your name, address and residence details with them. Postal services only use this data for the purpose of executing the agreement. In the event that the postal service engages subcontractors, this postal service will also make your data available to these parties.

 

Invoicing and accounting/Own Excel files

We use our own Excel files to maintain our administration and accounting. We include your name, address and residence details and details regarding your order. This data is used to administer sales invoices. Your personal data is sent and stored protected. Mobi-Movi is obliged to maintain confidentiality and will treat your data confidentially. Mobi-Movi does not use your personal data for purposes other than those described above.

Cooperation in tax and criminal investigations

In appropriate cases, Mobi-Movi are obliged to share your data on the basis of a legal obligation in connection with government tax or criminal investigations. In such a case we are forced to share your data, but we will oppose this within the possibilities offered by the law.

Retention periods

We keep your data as long as you are our client. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also regard this as a request to be forgotten. Based on applicable administrative obligations, we must keep invoices with your (personal) data, so we will keep this data for as long as the applicable period runs. However, employees no longer have access to your client profile and documents that we have produced in response to your assignment.

Your rights

Under applicable Dutch and European legislation, you as a data subject have certain rights with regard to the personal data processed by or on behalf of us. We explain below what these rights are and how you can invoke these rights. In principle, to prevent misuse, we only send copies and copies of your data to your email address already known to us.
